Terms & Conditions (AGB)
Scope of application
These General Terms and Conditions (GTC) apply to all contracts, deliveries and services concluded via the Woodletics online shop (www.woodletics.com). Deviating terms and conditions of the customer shall not be recognised unless Woodletics expressly agrees to their validity in writing.
Conclusion of contract
The presentation of products in the online shop does not constitute a legally binding offer, but serves as an invitation to place an order. By submitting the order, the customer makes a binding offer within the meaning of § 145 BGB (German Civil Code). The contract is concluded as soon as Woodletics confirms the order by email within two working days or dispatches the goods.
Prices and shipping costs
The prices stated at the time of ordering apply. All prices are final prices and include statutory value added tax. Shipping costs are charged additionally and displayed during the ordering process; further information can be found under ‘Shipping costs’. For deliveries outside the EU, additional costs such as customs duties, taxes or fees may apply, which are to be borne by the customer.
Delivery and delivery times
Delivery will be made within the delivery times stated on the product page. Delays due to force majeure, operational disruptions or delivery bottlenecks at suppliers entitle Woodletics to postpone delivery accordingly. Handcrafted products may also require longer production times.
Special features of handmade wooden products
Our products are mainly made of wood and are manufactured using traditional craftsmanship. Therefore, natural variations in structure, colour, grain and slight dimensional tolerances may occur. These characteristics are due to the production process and do not constitute a defect. Wood is a natural material that can change due to environmental influences such as temperature or humidity; this is also natural and does not constitute grounds for complaint.
Right of withdrawal & returns
Consumers generally have a right of withdrawal of 14 days after receipt of the goods. Individually manufactured or personalised products, such as products with engravings or custom-made products according to customer specifications, are excluded from the right of withdrawal. The customer bears the costs of the return shipment, unless otherwise agreed. Detailed information is provided in the cancellation policy.
Payment
Payment is made using the payment methods specified in the shop, such as PayPal, credit card or prepayment. Payment is due immediately after conclusion of the contract.
Retention of title
The goods remain the property of Woodletics until full payment has been received.
Warranty
The statutory warranty rights apply. Deviations resulting from craftsmanship tolerances or the natural material properties of wood are not considered material defects. For businesses, the warranty period is twelve months.
Liability
Woodletics shall only be liable for damages if these are based on intentional or grossly negligent breach of duty. In cases of slight negligence, Woodletics shall only be liable for damages resulting from injury to life, limb or health, as well as for breaches of essential contractual obligations (cardinal obligations), whereby liability shall be limited to foreseeable damages typical for this type of contract. Any further liability, in particular for indirect damage or loss of profit, is excluded. Liability under the Product Liability Act remains unaffected.
Transport damage
Customers are requested to check the goods for transport damage upon delivery and to report any damage to the delivery company immediately. Failure to make a complaint does not affect the statutory claims, but makes it easier to enforce them against the shipping service provider.
Dispute resolution
Woodletics is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
Note on Translations
The legally binding version of this information and our legal documents (such as Terms and Conditions, Payment and Shipping Conditions, Right of Withdrawal, Privacy Policy, Legal Notice) is the German version.
Translations into other languages are provided for convenience only and are not legally binding. In the event of discrepancies or contradictions, only the German version shall prevail.
Final provisions
The law of the Federal Republic of Germany applies. If the customer is a consumer, mandatory provisions of the country in which they have their habitual residence remain unaffected. If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is the registered office of Woodletics. Should individual provisions of these General Terms and Conditions be invalid, the validity of the remaining provisions remains unaffected.
